Transport of leftover paint: Sweden adheres to M346

Section 1.5.1 of ADR about temporary derogations declares that “the competent authorities of the contracting Parties may agree directly among themselves to authorize certain transport operations in their territories by temporary derogation from the requirements of ADR, provided that safety is not compromised thereby. The authority which has taken the initiative with respect to the temporary derogation shall notify such derogations to the Secretariat of the United Nations Economic Commission for Europe which shall bring them to the attention of the Contracting Parties”.

For instance, after the multilateral agreement M346 on the transport of paint residues (waste) has been signed by Germany and France, Sweden has now also signed the document as a third country, simplifying the transport of these dangerous goods by road.

As a result, waste consisting of packaging residues, solidified and liquid residues of paint residues may be transported under UN 1263 packing group II or UN 3082 in the three states. When transporting, it is now allowed to deviate from Section 3.2.1 of ADR (Table A, List of Dangerous Goods), Chapter 3.3, Chapter 4.1, Section 5.4.1, and Chapter 7.3. In addition to the regulations for UN 1263, packing group II and UN 3082, other specifications for the packaging and transport of paint waste have also been formulated. The first point of the agreement states, for example, that the waste may be packed following packing instruction P002 of subsection 4.1.4.1 or packing instruction IBC06 of subsection 4.1.4.2. mixed packaging of waste assigned to UN number 1263.

All other relevant regulations of the ADR are still valid and must be observed. This multilateral agreement is valid until July 31, 2025, in the three signatory countries.
